How our family lawyers work
We seek to avoid costly financial disputes by encouraging early negotiation and arbitration where appropriate. However, where necessary we take swift and firm court action to protect matrimonial assets, whether in the UK or abroad. We also provide advice to urgently establish the most favourable jurisdiction for our clients as timing of the start of proceedings can be crucial.
We have in-depth experience of obtaining and opposing domestic and international freezing orders, and taking effective steps to enforce financial awards and orders for financial disclosure. We act to protect clients who suffer harassment or threats from their spouses, partners, family or other individuals.
Members of our family team also have a solid background in commercial disputes, cross-border fraud cases, financial investigation and recovery. We are also able to draw on the expertise of corporate and property law experts throughout DMH Stallard when needed. This gives us the enhanced ability to tackle issues arising in family matters involving complex financial and business circumstances.
We offer a range of constructive and pragmatic approaches for funding divorce and other family law related matters.
How we've helped
- We acted for a husband in a case where there were international assets and the marriage had broken down. We gave the client swift advice as to jurisdiction and protection of assets. Divorce proceedings were issued in this country to enable him to reach the best outcome in the financial remedy case. The wife challenged jurisdiction in the High Court and Court of Appeal. We were successful in opposing her challenges and the husband’s financial claims were settled favourably within the proceedings in this country.
- We acted for a wife who was a non UK citizen living in this country and married to another non UK citizen. The matrimonial assets were in this country and abroad. We provided swift advice as to jurisdiction and a petition was issued in this country to limit the possibility of the husband issuing outside of this jurisdiction which if he had done so in advance of the issue of the wife’s petition may not have produced as favourable an outcome. The husband breached a number of orders relating to financial disclosure and we were successful in obtaining a prison sentence against him. We were then able to achieve a very favourable settlement which was made an order in the family division of the High Court.
- We acted at short notice for a wife involved in proceedings in the Isle of Man by providing English legal advice and representation. The work was concentrated and completed within an intensive two month period. The trial led to a successful outcome for the client.
